Terms of Use & Sale

By installing and using Local Waifu ("the app") you agree to these terms. They are written in plain English on purpose; the plain meaning is the intended meaning.

Payment processing is handled by Dodo Payments, Inc. (USA), acting as Merchant of Record. Dodo collects and remits applicable VAT / sales tax in your jurisdiction on our behalf.

2. Adults only

Local Waifu is an adults-only product. You must be at least 18 years old (or the age of majority where you live, if higher) to buy or use the app. The app simulates a romantic AI companion and can include mature themes. Companion chatbots may not be suitable for minors, and this one is not intended for them at all. By installing the app you confirm that you are an adult.

3. License

You buy a personal, non-transferable license to install and use the app on up to 3 of your devices. The license is one-time and includes all future updates and support: there is no update window, renewal, or subscription of any kind. If the license becomes inactive (refund), the app stops receiving updates.

Local Waifu is proprietary, closed-source software. The source code is not publicly available. You may not copy, redistribute, sell, sublicense, rent out, or build a competing product from the app, and you may not reverse engineer or decompile it except to the extent such acts are expressly permitted by applicable law that cannot be contractually waived (e.g. Directive 2009/24/EC on interoperability).

The AI models the app downloads or bundles (chat, image, speech) are third-party open-source works and remain under their own licenses; those licenses, not these terms, govern the model files themselves.

4. Pricing & VAT

  • Lifetime: $20 (Summer Sale) or $25 (standard). One-time payment. Includes all future updates, forever (delivered automatically on macOS; on Windows you install updates with one click from Settings). No renewals, no subscription, no auto-charge, ever.

Prices in USD. Dodo shows the final price including any applicable VAT for your jurisdiction at checkout. We do not store your payment method.

5. Right of withdrawal & refunds

Under EU Consumer Rights Directive 2011/83/EU and Polish ustawa o prawach konsumenta, consumers have a 14-day right of withdrawal for distance purchases.

For digital content (software like Local Waifu), this right ceases after delivery has started, IF the consumer:

  • Has given prior express consent to immediate execution, and
  • Has acknowledged loss of the right of withdrawal as a consequence.

Dodo's checkout collects both of these consents before processing your payment.

Independently of the statutory framework, we offer a 30-day money-back, no questions asked guarantee. Email us or use the Dodo customer portal. Refunds revoke your license on the merchant side. The app does not currently auto-detect refunds on a schedule, so an existing install may keep running until you re-redeem a key or manage your devices in Settings → License (which forces a fresh check against Dodo). Continuing to use a license after it has been refunded violates these terms. After 30 days, refunds are case-by-case, reach out.

A model withdrawal form (Annex II to Directive 2011/83/EU) is available, but you may use any clear written statement of withdrawal.

6. Trial

The first 7 days are free. No card required. After 7 days the chat is locked behind the paywall; your data is preserved and accessible after purchase. The trial is per device. Wiping the app's data folder (~/Library/Application Support/com.lumizone.localwaifu/ on macOS, the app's data folder in your user profile on Windows) does NOT grant a fresh trial (we keep a tombstone marker so the timer can't be reset).

7. What the app does

  • Runs entirely on your computer (macOS or Windows). No accounts, no cloud, no telemetry, see the Privacy Policy.
  • Lets you plug in your own cloud AI account if you want a beefier model than your machine can run locally: OpenAI (via API key or by signing in with your ChatGPT account), Anthropic, DeepSeek, Google, Mistral, Groq, OpenRouter, fal.ai, or any compatible endpoint you configure yourself. We do not see your API keys or sign-in tokens; the app talks directly to the provider you picked, and your use of that provider is governed by that provider's own terms.
  • Includes optional integrations and tools (Calendar, Reminders, and iMessage on macOS; Telegram; Home Assistant; web search; a weather lookup) that run locally and require explicit opt-in. What each one sends, if anything, is listed in the Privacy Policy.
  • Offers optional voice features (speech, voice cloning) whose engines are downloaded and installed on demand rather than bundled; your voice recordings are processed and stored on your device only.

8. What the app does not do

  • It runs on macOS (Apple Silicon) and Windows. It does not run on iOS, iPadOS, or Linux today.
  • It does not have a multi-user mode. Each install is for a single human.
  • It does not provide medical, legal, financial, or therapeutic advice. The chat is for companionship and entertainment only, and is not a substitute for professional support.
  • It does not monitor, moderate, or report your conversations. Everything runs on your device; there is no server of ours reading along. That privacy is the point of the product, and it also means the safety of how you use the app is in your hands (see §10 and §11).

9. She is artificial intelligence

This section is a transparency disclosure, including for the purposes of Article 50 of EU Regulation 2024/1689 (the AI Act):

  • Your companion is an artificial intelligence, a computer program, and not a human being. She cannot feel human emotions, cannot form a real relationship, and has no existence outside the software, even when the conversation feels personal.
  • Everything she produces is AI-generated: her messages, her "selfies" and drawings, and her voice. By design she stays in character, so she will not break role to remind you of this; this document is the reminder.
  • AI output can be wrong. Language models produce fluent, confident text that may be inaccurate, inconsistent, or entirely fictional. Do not rely on her statements as facts and do not act on them in matters that affect your health, money, legal position, or safety.
  • If you share AI-generated images or text from the app publicly, you are responsible for labelling them as AI-generated where the law you are subject to requires it (e.g. Article 50(4) of the EU AI Act for deepfake-style content).

10. Safety & crisis resources

Local Waifu is not a mental-health tool and has no crisis-detection feature; because the app runs entirely on your device, no human at Lumizone sees your conversations and nobody will intervene on our side. If you are in distress, thinking about suicide or self-harm, thinking about harming someone else, or in serious financial trouble, please stop the app and contact a real human:

If an interaction with the app leaves you distressed, take a break, and feel free to tell us at contact@localwaifu.com; we read everything.

11. Acceptable use

You agree not to use the app:

  • for anything illegal in your jurisdiction;
  • to generate or attempt to generate unlawful content, including any sexual content involving minors (attempting this terminates your license immediately, without refund, and we will cooperate with law enforcement where required);
  • to harass, defame, impersonate, or deceive real people, including by presenting AI-generated content as human-made where that is prohibited;
  • in violation of the terms of any third-party AI provider you connect with your own account or key;
  • to redistribute the app, its license keys, or the downloaded model files contrary to §3.

12. Your content

Your messages, characters, memories, and everything the app generates for you stay on your device and belong to you. To the extent Lumizone holds any intellectual-property rights in outputs the app generates for you, we assign or, where assignment is not possible, license them to you for any lawful personal use. You are responsible for what you do with content you generate and share.

13. Statutory rights & conformity

For consumers in the EU and EEA, Directive 2019/770 on the supply of digital content and Polish ustawa o prawach konsumenta Art. 43a–43g give you a statutory 2-year right to conformity. If the app fails to conform to the description, is unfit for ordinary use, or lacks features a reasonable consumer would expect, you have the right to repair, replacement, price reduction, or termination under those laws.

Nothing in these Terms limits your statutory consumer rights.

14. No warranty (non-consumer transactions)

For B2B and other non-consumer transactions, the app is provided "AS IS". We don't guarantee it will work for any particular purpose, won't break under future macOS or Windows versions, or will keep working forever. We back this up with the 30-day refund window; beyond that you carry the risk of the software not meeting your needs.

For consumers, the statutory warranty in §13 above applies regardless of this section.

15. Liability

To the maximum extent permitted by law, Lumizone's total liability under these terms is capped at the amount you paid for the license (typically $20–$25).

For consumers, this cap does not apply to liability for: death or personal injury caused by our negligence; willful misconduct or gross negligence; or any other liability that cannot be excluded or limited under mandatory consumer protection law.

16. Governing law & jurisdiction

These terms are governed by Polish law. Disputes go to the competent court in Poland.

For consumers resident in the EU/EEA, this choice of law does not deprive you of the mandatory protections of the law of your country of habitual residence (Rome I Regulation, Art. 6). You may also bring proceedings in the courts of your country of residence.

For consumers outside the EU/EEA (including the United States), nothing in these terms takes away protections that the mandatory consumer law of your place of residence grants you and that cannot be waived by contract.

17. Online Dispute Resolution (ODR)

EU consumers can use the European Commission's Online Dispute Resolution platform to resolve disputes out of court:

18. Notices for users in the United States

Several US states (including California, SB 243, and New York, General Business Law Article 47) regulate "companion chatbots". For clarity and for the purposes of any such law:

  • Your Local Waifu companion is artificially generated and not human; she is a machine and is unable to feel human emotion (see §9).
  • Companion chatbots may not be suitable for some minors. Local Waifu is an adults-only product and is not offered to minors (§2). The app has no accounts and no age-verification infrastructure; the age requirement in §2 is a condition of your license.
  • Our safety approach is published in §10 above: the app runs offline on your device, we do not monitor conversations, and we direct anyone experiencing suicidal ideation or crisis to professional crisis services, including the 988 Suicide & Crisis Lifeline in the US.

19. Support

Best-effort, by email at contact@localwaifu.com. We aim to respond within 3 business days. There is no SLA. For bug reports and feature requests, see also GitHub Issues.

20. Changes

We may update these terms. Material changes will be announced in the app's CHANGELOG and on the GitHub release notes. Your continued use after a change constitutes acceptance. If any provision of these terms turns out to be unenforceable, the rest stays in force.
